1. Acceptance of Terms

Welcome to ResumeYourWay.com (the "Site"), operated by MBH National INC. ("ResumeYourWay," "we," "us," or "our"). We provide resume writing, LinkedIn profile optimization, interview coaching, job placement assistance, and related career services (collectively, the “Services”).

By accessing the Site, purchasing our Services, or using the Content, you (the "Client" or "you") acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the "Agreement"). If you do not agree to these terms, you must not use our Site or Services.

We reserve the right to modify this Agreement at any time. Changes will be effective immediately upon posting the updated Agreement on the Site. Your continued use of the Site or Services after such changes constitutes your acceptance of the new Terms.

2. Description of Services and Client Obligations

ResumeYourWay provides professional document preparation and career coaching. Our Services rely significantly on the information provided by the Client.

  • Client Responsibility: The Client is solely responsible for the accuracy, completeness, and truthfulness of all information submitted to ResumeYourWay regarding employment history, education, skills, and objectives. We do not independently verify the information provided. ResumeYourWay is not responsible for inaccuracies in the final deliverables resulting from false or incomplete information provided by the Client.

  • Engagement: The Client agrees to respond promptly to communications, questionnaires, and requests for feedback. Delays caused by the Client’s failure to provide necessary information will extend the delivery timeline.

  • No Guarantee of Employment: ResumeYourWay does not guarantee job placement, interviews, or specific career outcomes. The success of your job search depends on many factors outside our control, including market conditions, your qualifications, and your personal efforts in the job search. Our Services are tools to assist in your search, not a guarantee of results.

3. Intellectual Property Rights

  • Site Content: The Site and all its original content, features, and functionality (including text, graphics, logos, and the compilation thereof) are the exclusive property of MBH National INC. and are protected by U.S. and international copyright and trademark laws.

  • Ownership of Deliverables: Upon full payment for the Services, ResumeYourWay grants the Client a perpetual, worldwide, non-exclusive license to use the final, approved documents (e.g., resumes, cover letters) (the "Deliverables") solely for the purpose of the Client's personal job search and career advancement.

  • Restrictions: The Client may not resell, redistribute, sublicense, or otherwise use the Deliverables for commercial purposes. The proprietary formats, templates, and strategic methodologies provided by ResumeYourWay remain the intellectual property of ResumeYourWay.

  • Use of Anonymized Samples: We reserve the right to use the Deliverables as samples on our Site or in marketing materials, provided that all personally identifiable information (PII) is removed or fictionalized to protect the Client's identity.

4. Payments, Cancellations, and Refunds

  • Payment: All Services must be paid for in advance. Payment is processed through our secure, encrypted payment system.

  • Cancellation Policy: Due to the customized nature of our Services and the intellectual labor involved, our refund policy is limited:

    • Before Work Commences: Cancellations received within twenty-four (24) hours of purchase, provided no substantive work (such as the initial consultation or drafting) has begun, are eligible for a full refund minus a 5% processing fee.

    • After Work Commences: Once the consultation has occurred or drafting has begun, the fees paid are considered earned. ResumeYourWay, at its sole discretion, may offer a partial refund based on the amount of work completed.

    • After Delivery: No refunds will be issued once the first draft of any Deliverable has been delivered to the Client.

  • Satisfaction Commitment (Revisions): Our commitment to satisfaction is managed through the revision process (see Section 5). We do not offer refunds based on dissatisfaction with the subjective style of writing, failure to secure interviews, or failure to obtain employment.

  • Chargebacks: The Client agrees to utilize the resolution processes outlined herein. Initiating a chargeback with your financial institution without first attempting resolution through ResumeYourWay constitutes a breach of this Agreement. We reserve the right to dispute any chargeback and recover associated fees.

5. Revision Policy and Project Finalization

  • Revision Period: Clients have seven (7) calendar days from the receipt of the first draft to request revisions.

  • Scope of Revisions: We offer a reasonable number of revisions (typically up to three rounds). Revisions are limited to correcting errors, addressing information provided during the initial intake, or refining the strategy previously discussed. Revisions do not include a complete rewrite based on new information, a change in career direction, or new job targets not provided initially. Such changes may incur additional fees.

  • Finalization: The project is considered finalized and closed if (i) the Client accepts the Deliverables, or (ii) no revisions are requested within the seven (7) day Revision Period.

  • Dormant Projects: If a Client fails to respond to communications or provide necessary information/feedback for forty-five (45) days, the project will be considered dormant. Dormant projects are not eligible for refunds, and a reactivation fee may apply to restart the Service.

6. Disclaimer of Warranties

THE SITE AND THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SITE AND SERVICES IS AT YOUR SOLE RISK.

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, RESUMEYOURWAY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. RESUMEYOURWAY DOES NOT WARRANT THAT THE FUNCTIONS PERFORMED BY THE SITE OR THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

7. Limitation of Liability

IN NO EVENT SHALL RESUMEYOURWAY, MBH NATIONAL INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR USE OF OR INABILITY TO USE THE SERVICE; (II) THE OUTCOME OF YOUR JOB SEARCH OR EMPLOYMENT DECISIONS MADE BY EMPLOYERS; (III) ANY CONTENT OBTAINED FROM THE SERVICE; OR (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF RESUMEYOURWAY EXCEED THE TOTAL AMOUNT PAID BY YOU TO RESUMEYOURWAY FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.

Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, some of the above limitations may not apply to you. In such states, liability is limited to the greatest extent permitted by law.

8. Indemnification

You agree to defend, indemnify, and hold harmless ResumeYourWay, its parent company, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (a) your use of the Site and Services; (b) your violation of any term of this Agreement; or (c) the inaccuracy or untruthfulness of the information you provided for the Services.

9. Governing Law

This Agreement shall be governed and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.

10. Dispute Resolution: Mandatory Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

  • Initial Dispute Resolution: Before filing a claim, you agree to try to resolve the dispute informally by contacting Support@ResumeYourWay.com.

  • Binding Arbitration: If a dispute cannot be resolved within 30 days, both parties agree to resolve any claim, dispute, or controversy arising out of or in connection with this Agreement through binding arbitration by the American Arbitration Association (AAA) under the Commercial Arbitration Rules then in effect. The arbitration will be conducted in the Commonwealth of Virginia, unless otherwise agreed.

  • Class Action Waiver: ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. YOU AGREE THAT YOU AND RESUMEYOURWAY ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

11. General Provisions

  • Entire Agreement: This Agreement constitutes the entire agreement between you and ResumeYourWay regarding the use of the Site and Services.

  • Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions of this Agreement will remain in effect.

  • Password Security: If you create an account, you are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.
